FURTILO DELIVERY PARTNER TERMS & CONDITIONS

These Delivery Partner Terms & Conditions ("Terms") govern access to and use of the Furtilo platform by delivery partners.
By clicking "I Agree", registering, or performing any services through the Furtilo platform (the "Platform"), you expressly agree to be bound by these Terms.
1. DEFINITIONS
- "Furtilo" / "Company" means Kuvi Technologies Pvt Ltd, operating under the brand name Furtilo.
- "Platform" means the Furtilo mobile application, website, and related technology systems.
- "Delivery Partner" / "Partner" / "You" means any individual registered to provide delivery, parcel, or bike taxi services.
- "Customer" means end users requesting services through the Platform.
- "Merchant" means restaurants or businesses listed on the Platform.
2. NATURE OF RELATIONSHIP
2.1 You acknowledge that you are an independent contractor and not an employee, agent, partner, or representative of Furtilo.
2.2 Nothing in these Terms creates an employment relationship, partnership, joint venture, or agency.
2.3 You retain full control over your working hours and choice to accept or reject service requests.
3. ELIGIBILITY & ONBOARDING
You represent and warrant that:
- You are at least 18 years of age
- All information provided is accurate and up to date
- You possess valid government-issued identification
- You hold a valid driving license (where applicable)
- You have lawful access to a roadworthy vehicle and smartphone
Furtilo may suspend or deactivate access if information is false or misleading.
4. BACKGROUND VERIFICATION
4.1 Furtilo may conduct identity checks, document verification, and background screening at onboarding and periodically thereafter.
4.2 You consent to Furtilo obtaining information from third parties or government databases for verification purposes.
4.3 Failure to meet verification standards may result in suspension or permanent deactivation.
5. SERVICES SCOPE
You may be offered opportunities to perform:
- Food delivery
- Parcel delivery
- Bike taxi (two-wheeler passenger transport)
- Other logistics or mobility services enabled on the Platform
Furtilo does not guarantee minimum earnings, orders, or availability.
6. PARTNER OBLIGATIONS & CONDUCT
You agree to:
- Perform services safely, professionally, and lawfully
- Follow traffic laws, safety guidelines, and platform instructions
- Treat customers, merchants, and the public respectfully
- Not engage in fraud, abuse, harassment, solicitation, or misconduct
- Not misuse the Platform, manipulate ratings, or use automated tools
7. PAYMENTS, FEES & INCENTIVES
7.1 Earnings are calculated per completed task as displayed on the Platform.
7.2 Furtilo may deduct service fees, penalties, advances, or applicable taxes.
7.3 Payments will be settled periodically via approved payout methods.
7.4 Incentives or bonuses are discretionary and subject to separate conditions.
7.5 Furtilo may withhold or adjust payments in cases of disputes, fraud, or violations.
8. EQUIPMENT, COSTS & INSURANCE
8.1 You are solely responsible for all costs related to vehicles, fuel, maintenance, mobile devices, data, and safety equipment.
8.2 Furtilo does not provide insurance coverage unless expressly stated.
8.3 You are responsible for personal safety, vehicle condition, and legal compliance.
9. DATA COLLECTION & PRIVACY
9.1 Furtilo may collect and process personal data including identity documents, location data, performance metrics, and transaction history.
9.2 Data may be used for onboarding, operations, safety, fraud prevention, analytics, and legal compliance.
9.3 Data may be shared with service providers, merchants, or authorities as required by law.
10. INTELLECTUAL PROPERTY
All Platform technology, branding, and content remain the exclusive property of Furtilo. No ownership rights are granted to Partners.
11. PERFORMANCE MONITORING
Furtilo may monitor performance metrics including acceptance rates, punctuality, ratings, and complaints.
Consistent poor performance may result in penalties, suspension, or deactivation.
12. BIKE TAXI SERVICES – ADDITIONAL TERMS
12.1 Nature of Bike Taxi Services
- Bike taxi services involve transporting one passenger on a two-wheeler.
- You operate independently and are not an employee or transport provider of Furtilo.
12.2 Safety Obligations
You must:
- Wear protective gear including helmet
- Ensure the passenger wears a helmet where required by law
- Operate the vehicle safely and lawfully at all times
12.3 Ride Conduct
- You may refuse rides where safety is compromised or laws would be violated.
- Routes and ride duration may vary due to external conditions.
13. PARCEL SERVICES – ADDITIONAL TERMS
13.1 Parcel Restrictions
You must not accept parcels containing prohibited or illegal items including hazardous materials, cash, narcotics, or items restricted by law.
13.2 Handling Obligations
- Parcels must not be tampered with.
- You must handle parcels with reasonable care but are not responsible for internal contents unless damaged due to negligence.
14. SUSPENSION, INVESTIGATION & TERMINATION
14.1 Furtilo may suspend or deactivate access immediately for safety, legal, or policy violations.
14.2 Furtilo may investigate complaints and request information.
14.3 Termination may occur without prior notice at Furtilo’s discretion.
15. LIMITATION OF LIABILITY
Furtilo shall not be liable for accidents, injuries, loss of income, or damages arising during service. Total liability, if any, shall not exceed earnings paid to you in the preceding one (1) month.
16. INDEMNITY
You agree to indemnify and hold harmless Furtilo from all claims, losses, damages, liabilities, or expenses arising from your negligence, misconduct, or breach of these Terms.
17. FORCE MAJEURE
Furtilo shall not be liable for failure or delay due to events beyond reasonable control.
18. MODIFICATIONS
Furtilo may modify these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
19. LANGUAGE & TRANSLATION
These Terms are drafted in English. Translations are for convenience only; the English version shall prevail.
20. GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of India. Courts at Bengaluru, Karnataka shall have exclusive jurisdiction.
